Refund Policy - the basics
DVZ Roofing is committed to delivering high-quality roofing services with transparency, fairness, and full compliance with Texas law. This Refund Policy outlines the conditions under which refunds may be issued, and the legal and ethical standards that apply to insurance-funded roofing projects.
1. Eligibility for Refunds
Refunds may be considered under the following circumstances:

Client cancellation prior to material purchase or crew mobilization

Overpayment due to billing error or duplicate transaction

Failure to perform contracted services due to internal company issues (excluding weather-related delays)

Mutual termination of contract with written agreement from both parties
Refunds will not be issued for:

Work already completed and approved
-
Insurance-funded projects where deductible obligations are unmet

Cancellations after materials have been ordered or labor has been mobilized
-
Delays caused by weather, acts of God, or other uncontrollable external factors
Note: Weather delays are considered a normal and foreseeable part of roofing operations in Texas. They do not constitute grounds for termination or refund.
2. Texas Deductible Law Compliance (HB2102)
Under Texas House Bill 2102, it is illegal for contractors to waive, absorb, or rebate a property insurance deductible. Therefore:

Refunds will not be used to offset or reimburse deductibles

All contracts over $1,000 involving insurance proceeds must include the following notice in 12-point boldface type:
“Texas law requires a person insured under a property insurance policy to pay any deductible applicable to a claim made under the policy. It is a violation of Texas law for a seller of goods or services who reasonably expects to be paid wholly or partly from the proceeds of a property insurance claim to knowingly allow the insured person to fail to pay, or assist the insured person's failure to pay, the applicable insurance deductible.”
3. Insurance-Funded Projects
For projects funded by insurance:

Refunds will only be issued for documented overpayments or billing errors

DVZ Roofing will not act as a public adjuster or negotiate claim settlements

Clients must provide proof of deductible payment before final invoices are closed or refunds are considered
Acceptable proof includes:

Canceled check or bank statement
-
Credit card receipt
-
Signed payment plan agreement
4. Accommodations and Flexibility
DVZ Roofing is committed to ethical service and accessibility. If a client faces financial hardship, disability, or other limitations:

We may offer flexible payment plans or rescheduling options

Refunds or credits may be considered on a case-by-case basis with proper documentation
-
We will never compromise legal compliance or insurance integrity in offering accommodations
5. Requesting a Refund
To request a refund, please contact us within 10 business days of the qualifying event,
Include your name, project address, invoice number, and reason for the request. We will respond within 5 business days.
6. Governing Law
This policy is governed by the laws of the State of Texas, including:
